Negotiation 360 Privacy Policy

Negotiation 360, LLC (“we” or “us”) provides the Negotiation 360 mobile application and associated content (collectively, the “Application”) as well as a related website at https://negotiation-360.com (the “Site”).

This Privacy Notice (this “Notice”) describes the types of information we may collect from you or that you may provide to us when you install and use the Application or visit the Site, use any additional services we may provide, or otherwise interact with us.

This Notice also describes our practices for using and sharing information about you, as well as choices you have regarding your information.

Applicability of This Notice

This Notice is part of our Terms of Use (available through the Application or online at https://negotiation-360.com/terms), which govern your use of the Application and the Site. We may update our Terms of Use and/or this Notice from time to time. Whenever we do so, we will include the applicable effective date at the top of the page. Whenever you use the Application or the Site or otherwise provide us with information, you are indicating that you agree to the most recent version of our Terms of Use, including this Notice, and you are consenting to our collection and use of information as described in this Notice, so please check our Terms of Use and this Notice regularly for updates. 

This Notice applies to Personal Information we collect through the Application and the Site. “Personal Information” is information that can be used to identify you (such as your name, email address or other contact information) and other information that is linked to your personal identifiers (such as usernames, and passwords). This Notice applies only to information that is Personal Information. For example, if we create aggregated anonymous data that cannot be used by someone else to identify you, that data is not covered by this Notice. This Notice also does not apply to other applications or websites or to the practices of any third parties.

Information We Collect

We collect several types of information, including Personal Information, from and about users of the Application and the Site. We collect this information directly from you when you chose to provide it to us, and automatically when you install and use the Application or navigate through the Site. We may also collect information about you from other sources. In the following sections we explain how and why we collect various types of information about our users.

Information You Provide

We collect information, including Personal Information, when you choose to provide it to us. For example, if you decide to become a Registered User of the Application, you may be asked to select a user name and password and verify your email address, or you may be invited to sign on through a social media account, such as LinkedIn, in which case you may be asked to provide us with your LinkedIn user name. We use this information to create and maintain your user account, verify your identity, and communicate with you about your account. You may also choose to provide other information, including:

We use this information to deliver the features of the Application and the Site that you request, such as to enable you to retrieve and review your notes or your negotiation scorecard, respond to your inquiries, provide customer support, and share your User Content. We also use this information to evaluate and improve the Application, customize your user experience, personalize our communications to you, and for other reasons that you request or that we make known to you at the time you choose to provide the information. 

Please note that the creation, submission, and use of User Content is subject to specific requirements described in our Terms of Use. 

Information We Collect Automatically

As you use the Application or the Site, we may collect information from or about you automatically using standard technologies, such as cookies, Web beacons, and third-party analytics services. 

A cookie is a small file that is stored on your device when you install an application or visit a website. It allows the application or website to recognize your device or recall your settings. You can block cookies or delete them by following the instructions for your device or browser, but not all of the features of the Application or the Site may work as intended if you block our cookies. 

A Web beacon (or a pixel “GIF”) is an invisible digital object on a webpage or email. Web beacons are used to collect information about interactions with the webpage or email, such the number and duration of visits to a webpage. 

Analytics services are provided by third parties to measure various uses of an application or webpage, including general geographic location, browsing actions, and similar information for compiling and analyzing statistical data. These third parties may also use automatic technologies like browser cookies and Web beacons.

We use automatically-collected information to make the features of the Application and the Site available to you, evaluate and improve the Application and the Site, customize your user experience, and perform market research. We may use this information to present selected content to you, or to invite you to participate in discussion forums, surveys, contests, promotions or other interactive features of the Site that we believe may be of interest to you based on your interests and activities on the Site.

Information We Share

We will share your Personal Information with non-affiliated third parties only as described in this Notice, unless we obtain your specific consent otherwise. 

We may share your Personal Information with service providers with whom we have contracted to provide products or services that help us develop, operate, maintain, and improve the Application and the Site. These may include email or other communications service providers, and providers of platforms for customer support, surveys, content delivery, database management, hosting, cyber security, and interactive features of the Application or the Site. Service providers must treat your Personal Information as confidential and use it only to provide the services for which we have engaged them. 

We may disclose certain information for the purpose for which you provided it. For example, if you submit User Content that you decide to share with another user or share on your social media account, the information you provide, which may include Personal Information, will be shared accordingly.

Some third parties may collect your Personal Information directly in the course of your interactions with them. For example, when you purchase and download the Application from an app store, the app-store provider may collect Personal Information about you. When that is the case, your Personal Information will be subject to the privacy policies and other applicable terms of those third parties. But if they share your Personal Information with us, we will treat it in accordance with this Notice.

We may also use your Personal Information to help protect against fraudulent or unauthorized activities, improve security, comply with applicable law or legal obligations, cooperate with law enforcement or other governmental authorities, investigate complaints, defend against legal claims, protect the rights and safety of our organization and our employees and users, or enforce this Notice and our Terms of Use. 

If we are acquired by or merge with another company or go through a similar major corporate event involving a detailed review of our business and operations by third parties, we may disclose your Personal Information as part of such a review. Any such review will be subject to a confidentiality agreement that will restrict the use of your Personal Information.

Third- Party Analytics Services

Security

We have implemented commercially reasonable and appropriate measures to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. Your purchase of the Application is handled by the applicable app store; we do not possess or retain any payment information. The safety and security of your Personal Information also depends on you. For example, if you are a Registered User, you are responsible for keeping your password confidential. Unfortunately, the transmission of information online is not completely secure, and despite the security measures we have implemented, we cannot guarantee the security of your Personal Information transmitted to or through the Application or the Site. 

Your Choices and Rights

You may update, correct, or delete information about you at any time by using the tools and settings available to you through the Application and the Site or by contacting us at the address listed below. You may elect not to receive promotional communications from us by following the opt-out or unsubscribe instructions included in any such communication or by sending your request to us. If you are a Registered User, however, we may continue to communicate with you about your account, as needed. 

We may enable you to invite others to try the Application or visit the Site by providing their contact information. We may store and use the contact information of these other potential users in order to extend invitations to them and for no other purpose without their consent. These other potential users will always have the opportunity to opt-out of receiving further communications from us. 

We do not track our users over time and across third-party applications or websites, and therefore we do not recognize or respond to browser-initiated “Do Not Track” signals. 

We do not disclose information to third parties for marketing purposes. Accordingly, if you are a California resident, your right to request information relating to the disclosure of information for marketing purposes does not apply to us. 

You may have additional rights under applicable law. For example, you may have the right to obtain a copy of your Personal Information or to request deletion of certain Personal Information. We will make reasonable efforts to comply with such requests where applicable, but we may refuse such requests where we are otherwise legally required to retain the information, or where the requests are unreasonably repetitive, require disproportionate technical effort, create privacy risks for others, or are impractical. 

Notice to Non-U.S. Residents

We are based in the United States, the Site is directed primarily at users in the United States, and all of our data processing activities occur in the United States. Accordingly, the information we collect is governed by United States law, which may be different from the laws applicable to Persona Information in your country of residence. Any Personal Information you provide to us will be transferred to, processed, and stored in the United States. By providing us your Personal Information or using the Application or the Site, you consent to our collection, transfer, processing, and storage of your Personal Information in the United States in accordance with this Notice and our Terms of Use.

Children

The Application and the Site are intended for adults and are not directed to minors. We do not knowingly collect any information, including Personal Information, from minors. If you become aware that your minor child has provided us with Personal Information, please contact us. If we become aware that a minor has provided us with Personal Information, we will take steps to remove such information and, if applicable, terminate that minor’s account.
